Trial set in bid to force out Spirit Lake school officials

Judge Patrick Carr has set a date for the non-jury trial in the suits attempting to remove two Spirit Lake School Board members from office.

The bench trial will be held October 10 to remove Beth Will and Ann Goerss as president and vice president of the Spirit Lake School Board.

Six community members brought the suits earlier this year, alleging that the two engaged in open meetings law violations. The plaintiffs have now posted the required $90,000 bond to cover potential legal costs, which prevented the suits from being dismissed.

The action was brought after the board allegedly overspent its spending authority and had to make a million dollars in budget cuts. After a Physical Plant and Equipment levy vote failed, the district was forced to begin cutting staff positions. The board has been under fire since February, when high school principal Jedd Sherman resigned under duress.
